Sitsler set for plea

A jury term is underway in Mayes County District Court, but Jason Daniel Sitsler will not go to trial.

Sitsler, of Salina, has been given a Jan. 7, 2013, date to enter a guilty plea on charges of assault and battery with a dangerous weapon, first degree robbery and kidnapping. He was charged with the crimes on Jan. 24.

Sitsler, 31, allegedly struck Ethan Hall with an ax handle, robbed him of his wallet and cell phone at gun point, then kidnapped him. Sitsler has been free on $100,000 bond.

Sitsler was on probation from a case filed Aug. 22, 2011, in Mayes County District Court when the kidnapping incident occurred. On Feb. 24, Sitsler pleaded guilty to possession of a controlled drug with intent to distribute. He was sentenced to four years in the Department of Corrections. The sentence was deferred and Sitsler was given two years probation.

Assistant District Attorney Marny Hill said she will present a motion to accelerate that sentence Friday in front of Judge Shawn Taylor.

The plea agreement will require Sitsler to serve five years in the Oklahoma Department of Corrections.

While on bond for the kidnapping case, Sitsler was charged with entering with intent to steal copper and possession of stolen copper on Oct. 15. He was wearing a GPS monitor on his ankle when the theft occurred.

“Unless he can prove his ankle wasn’t there,” Hill said, “that will be a tough one.”

The copper case rolls into the plea agreement. While the deal is not solidified until the plea is made, Sitsler will not go to trial.
