Pryor, Salina fence line dispute continues

The feud over the fence line continues.
City Attorney Randall Elliott asked Pryor’s City Council for direction to handle the correction of the fence line between Salina and Pryor.
Elliott and Settle Engineering will investigate the situation and establish the correct legal description. The council requested that Elliott draft a preliminary ordinance to accept the encroachment.
Elliott also reported on the legal options against Jim Butler Construction and Mid-Continent Casualty for the repair of the floor in the fitness room at Pryor Creek Recreation Center. The problem originated when the roof leaked causing damage to small section of the floor. The floor was not correctly repaired, and is now unusable.
Tri-State Floors was asked to conduct another inspection. They discovered standing water behind the baseboards. The moisture content of the floor is also too high and the only remedy is a new floor at an estimated cost of $100,000. The insurance company has inspected the floor again, however the adjuster has not given his assessment at this time. The group fitness classes have been moved to the gym.
City Attorney Elliott presented the revised zoning code ordinance for C-R Restricted Commercial District City Zoning Code, Chapter 12-296 1-E to add service in addition to sales of new and used vehicles. The council rejected the resolution requesting Federal Aid Surface Transportation Program Project for South Elliott Street from Southeast 29th Street including the intersection north to Ridgewood Drive a distance of .180 miles.
The resignation of Robert A. Guderian from the Planning and Zoning Board was accepted.
“Anyone interested in serving please contact me,” said Mayor Jimmy Tramel.
The resignation of street department worker Bobby Cauthron was also accepted.
The council approved the reimbursement of $267 to the Pryor Area Chamber of Commerce for advertising expenses from the Hotel/Motel grant funds.
The property located at 21 South Orphan owned by George Vernon Conn was declared a nuisance. The city will begin immediate clean-up of the property.
The property located at 1609 Ginger Court was also declared a nuisance. The city will have cars on the property towed.
The property at 805 South Jackson owned by David Henson has been mowed and cleaned up. The council gave them until the Aug.7 meeting to remove a structure.
No action was taken on the property owned by Doug and Lisa Simmons at 306 North Rowe.
The property located at 28 South Taylor owned by Frank Lalicker was declared a nuisance the city will mow the grass and remove the trash.
The city council approved the jail use agreement with the Mayes County Board of Commissioners, and the City of Pryor Creek beginning July 1, and ending June 30, 2008.
The 25- year lease between the Department of Army Corps of Engineers and City of Pryor Golf Course was approved.
The services of Kolker and Kolker for the year ending June 30, 2007 and additional services for fiscal year 2007-2008 was approved.
The council approved the expenditure of $9,866.05 for 2007-2008 membership dues to the Oklahoma Municipal League.
The council approved the payroll purchase orders through June 29 and the claims for purchases orders through July 3. The receipt of deficient purchase orders and the transfer of sales tax funds to the Utility Systems Improvement Fund was approved.
The City of Pryor is fogging for mosquitoes daily from 11:45 p.m. until 4 a.m.
Larry Smith addressed the council concerning the abatement of the alley behind his house. He feels his rights have been violated and the city is not in compliance with the state and city codes.
