PRYOR, OK —
A bench warrant was issued for the arrest of Terry Walters Friday. Walters, 32, Pryor, is charged with negligent homicide with a motor vehicle, speeding and reckless driving. The charge is filed as a misdemeanor.
On April 18, Waters was allegedly driving a 1998 Ford Crown Victoria westbound on 440 Road when he was involved in a single-vehicle collision that resulted in the death of Brandi Linell, according to the affidavit for arrest.
“After the collision, Walters stated he and Linell were traveling to his grandparents’ residence where his grandfather had just died,” according to the affidavit. “Walters stated he was traveling approximately 65 or 70 mph.”
The posted speed limit on 440 Road is 45 mph.
“Walters stated he ran into some standing water on the roadway and lost control of the vehicle. The vehicle ran off the roadway, struck a tree and overturned, ejecting Linell. Linell was pinned under the vehicle and was pronounced deceased by MESTA,” the affidavit continued.
Walters appeared in Mayes County District Court Monday for arraignment. Walters was present in the courtroom, in jeans and a white T-shirt, having posted his $2,000 bond. When asked, the defendant entered a plea of not guilty and his case was continued to the jury sounding docket Feb. 21.
Walters has a prior criminal record in Mayes County that includes public intoxication.
