Assault at Pizza Hut

A Salina man is facing felony aggravated assault and battery charges after a June 5 incident at the Pizza Hut in Pryor.

A warrant for the arrest of Nathan Todd McGrew, 34, was issued on June 18. He turned himself in.

According to the probable cause affidavit, Officer Dustin Van Horn was dispatched to the scene and met with the alleged victim, Will Day.

Day, who works at the restaurant, identified McGrew as his attacker, telling Van Horn that McGrew confronted him in the parking lot regarding a conflict between Day and a co-worker, identified as McGrew’s wife.

Day was treated at the hospital for his injuries which included a facial fracture and fractured nose.

Van Horn questioned several employees of Pizza Hut, all who corroborated the statement given by Day.

McGrew was also questioned by Van Horn and admitted confronting Day about the alleged conflict.

“McGrew stated that while confronting Day, he saw Day raise one of his hands,” Van Horn stated in the probable cause affidavit. “Unsure if Day was going to strike, McGrew decided to strike Day in the face.”

McGrew is due back in court on Aug. 15, at 9:30 a.m. According to court records, he is represented by John Crockett.
