PRYOR, OK — Joe Matthew Estes will not stand trial for rape by instrumentation after Assistant District Attorney Marny Hill entered a motion before Judge Terry McBride that the count be dismissed.

Estes was charged in 2012 with the rape by instrumentation of an ex-girlfriend. He was also charged with rape by instrumentation and lewd molestation of a minor.

The cases were to be tried separately.

Estes stood trial in late July for the charges involving a minor. He was found not guilty by jury.

A trial date had been set for Dec. 19 in the case involving the ex-girlfriend who is also the mother of his two sons.

With the dismissal of the remaining charges, the bond for Estes was exonerated which means that any money or property used to secure the bond will be returned.
